Selected Online Reading on European Criminal Law and the European Arrest Warrant

European criminal law is explained as a multi-level field of law, in which the European Union has a normative influence on all criminal proceedings, but also on aspects of substantive criminal law and on the co-operation between Member States. This book aims to analyse the contours of the merging criminal justice system of the European Union and to present a coherent picture of the legislation enacted and the case law on European Union level and its influence on the national criminal justice systems, with specific attention for the position of the accused. Among the topics and questions covered in this book are the following: What does mutual recognition mean in the context of the European Arrest Warrant? How can European Union law be invoked by an accused standing trial in a national criminal proceeding? When is the Charter of Fundamental Freedoms applicable in national criminal proceedings?

Die EU-Mitgliedstaaten sind zur Gewahrleistung von Sicherheit auf grenzuberschreitende Kooperation angewiesen. Eines der zentralen Instrumente der Europaischen Strafkooperation stellt nach wie vor der Europaische Haftbefehl dar, der das Konfliktpotenzial dieser Instrumente markant zum Ausdruck bringt: Wahrend er sein Ziel eines schnelleren und effektiveren Systems der Auslieferung bzw. der Ubergabe erreicht und damit zur Kriminalitatsbekampfung in der Union beigetragen hat, erweist sich dieses beschleunigte Verfahren zugleich in hohem Masse als grundrechtssensibel. Vor diesem Hintergrund untersucht Joachim Rung die Regelungen des Rahmenbeschlusses uber den Europaischen Haftbefehl mit Blick auf die Unionsgrundrechte der Charta und formuliert Leitlinien fur die Auflosung etwaiger Konflikte; dabei reicht die Untersuchung insbesondere vom Recht auf Freiheit uber die Justiz- und Verfahrensgrundrechte bis hin zur Frage eines allgemeinen Grundrechtsvorbehalts.

L’espressione “diritto penale” e l’aggettivo “europeo”, fino a non molti decenni fa, sembravano porsi tra loro in un rapporto di reciproca incompatibilità strutturale: una sorta di specularità tendente all’ossimoro, che, in qualche modo, chiudeva la partita di una pretesa europeizzazione del diritto penale ancor prima del suo fischio di inizio. Lo scenario è cambiato in maniera tanto evidente quanto radicale, proiettando l’intero diritto punitivo in un sistema delle fonti sempre più complesso e poliedrico, con il quale l’interprete è necessariamente chiamato a confrontarsi. Questo volume raccoglie le lezioni del corso di “Diritto penale europeo” svolte presso il Dipartimento di Giurisprudenza dell’Università degli Studi “Roma Tre”. L’obiettivo è quello di offrire agli studenti una sintesi delle principali linee evolutive registratesi sul duplice versante che, a costo di qualche semplificazione linguistico-concettuale, si è ormai soliti ricondurre entro l’etichetta dell’attributo “europeo”: da una parte, il diritto eurounitario e, dall’altra parte, il sistema CEDU.

This book examines the European arrest warrant as a successful and effective instrument for judicial co-operation in criminal matters in the European Union. Providing comprehensive content and combining theoretical and practical aspects, it covers all of the major issues surrounding the European arrest warrant. The book analyses its genesis, main features, surrender procedure, case law, implementation and the latest developments. Instead of focusing solely on a criminal law approach, it also considers the subject from the perspective of European Union law and constitutional law.

The European Union and Deprivation of Liberty examines the EU legislative and judicial approach to deprivation of liberty from the perspective of the following fundamental rights and principles: the principle of legality and proportionality of penalties; the right to liberty; and the principle that criminal penalties must aim for the social reintegration of the offenders. The book measures the relevant EU law against those rights; this constitutes the very core of the relationship between public powers and individual liberty. The analysis shows that the ultimate goal of the Union is the creation and preservation of the EU as a borderless area. The holistic approach adopted in the book explains how different legal phenomena connected to deprivation of liberty have come into being in EU law. It also shows that those phenomena call for solutions suitable for the peculiarities of the EU legal order.

La cooperazione giudiziaria internazionale -- I provvedimenti di attuazione in materia di cooperazione giudiziaria penale nell'Unione Europea

A partir de la firma del Tratado de Lisboa a fecha de 13 de diciembre de 2007 y la introducción del artículo 82 del Tratado de Funcionamiento de la Unión Europea (TFUE), ha tenido lugar la promulgación en el seno de la Unión Europea de abundante normativa procesal penal de obligado cumplimiento en los Estados miembros mediante la fórmula de directivas, las que han de ser transpuestas en tiempo y forma en la legislación nacional. La base jurídica para ello se encuentra en sendos principios descritos en anterior artículo 82.1 TFUE, así principios de reconocimiento mutuo y aproximación legislativa, que articulan hoy día la cooperación judicial en materia penal existente entre los distintos Estados Miembros y con ello el hoy denominado " espacio judicial europeo " en el marco del Espacio de Libertad, Seguridad y Justicia (ELSJ).

Europejski nakaz dochodzeniowy. Nowy model współpracy w sprawach karnych w Unii Europejskiej” zawiera syntetyczną analizę jednego z najważniejszych elementów współpracy sądowej w sprawach karnych ze stosunków międzynarodowych, jakim jest transgraniczne gromadzenie materiału dowodowego. Książka nie tylko omawia poszczególne etapy rozwoju systemu międzynarodowego pozyskiwania dowodów, ale ukazuje również ciągłość i komplementarność prawa UE w tym zakresie. Ma to szczególne znaczenie dla praktyków prawa, którzy – otrzymując nowe narzędzie w postaci europejskiego nakazu dochodzeniowego – winni, tam gdzie jest to możliwe, analizować i stosować nowe rozwiązania w świetle dotychczasowych przepisów i procedur. Over the past 20 years the European Union has been increasingly active in the area of criminal law. Meanwhile, the status of European Union citizenship has been progressively developed and strengthened. Adopting an expressive and communitarian perspective of the criminal law, this book considers EU criminal law in light of EU citizenship with a view to revealing the structure of the EU's political community as expressed in its criminal law. It argues that while national communities remain dominant, through transnational processes certain features of a supranational community can be said to emerge. The book will be of interest to scholars of EU citizenship, EU criminal law and EU law and integration more generally.
