Rule of Law

The current discussion on the rule of law, especially in the EU, seems to be developing because the terms that express the idea of the rule of law in different European languages do not convey the same content. The rule of law, der Rechtstatt, l'etat de droit, to name just three language versions, were coined in different historical contexts and within different traditions of political thought. The question then becomes, to what extent is diversity in the understanding of the rule of law still legitimate today? The answer is sought in the book we have edited, whose authors are academically recognized individuals representing these different traditions of legal and political thinking. The publication is divided into three parts. The first part explains the concept of the rule of law and outlines the development of the idea of the rule of law. The analyses presented also address the issue of legal positivism seen as a minimization of the idea of the rule of law. In addition, this part includes articles on the problem of the rule of law from the perspective of Catholic social thought, as well as a consideration of the transformation of the legal concept of the rule of law into a kind of political fetish. Part two is devoted to various European traditions of understanding the rule of law. In this part of the book, the reader will find articles on approaches to the issue of the rule of law from the Anglo-Saxon, French, German, and Polish perspectives. The third part of the book deals with the issue of the rule of law from the perspective of the European Union. It is about the mechanisms of control of the rule of law in the Member States and the possibility of applying this concept to the EU.

Forgée à la fin du XIXe siècle dans la doctrine juridique allemande puis transposée en France pour répondre à l'exigence de fondation du droit public, la théorie de l'État de droit a connu au XXe siècle de sensibles inflexions : le défi totalitaire a conduit au dépassement de la conception purement formelle, reposant sur l'idée de hiérarchie des normes, au profit d'une conception substantielle privilégiant la garantie de la sécurité juridique et des libertés fondamentales. Si l'État de droit a été depuis les années quatre-vingt promu au rang de standard international, auquel tout État est tenu de se conformer, l'édifice est resté fragile. eLe reflux du modèle politique libéral à partir des années 2000 a contribué à mieux marquer les limites d'une vision qui avait été trop vite parée des attributs de l'universalité. Dans les pays libéraux eux-mêmes, la coyance dans les vertus de l'État de droit a tendu à s'effriter au cours des dernières années, sous la pression de menaces nouvelles.

This edited volume examines the role of international law in a changing global order. Can we, under the current significantly changing conditions, still observe an increasing juridification of international relations based on a universal understanding of values? Or are we, to the contrary, facing a tendency towards an informalization or a reformalization of international law, or even an erosion of international legal norms? Would it be appropriate to revisit classical elements of international law in order to react to structural changes, which may give rise to a more polycentric or non-polar world order? Or are we simply observing a slump in the development towards an international rule of law based on a universal understanding of values? In eleven chapters, distinguished scholars reflect on how to approach these questions from historical, system-oriented and actor-centered perspectives. The contributions engage with the rise of European international law since the 17th century, the decay of the international rule of law, compliance as an indicator for the state of international law, international law and informal law-making in times of populism, the rule of environmental law and complex problems, human rights in Europe in a hostile environment, the influence of the BRICS states on international law, the impact of non-state actors on international law, international law's contribution to global justice, the contestation of value-based norms and the international rule of law in light of legitimacy claims.

Rule of law and constitutionalist ideals are understood by many, if not most, as necessary to create a just political order. Defying the traditional division between normative and positive theoretical approaches, this book explores how political reality on the one hand, and constitutional ideals on the other, mutually inform and influence each other. Seventeen chapters from leading international scholars cover a diverse range of topics and case studies to test the hypothesis that the best normative theories, including those regarding the role of constitutions, constitutionalism and the rule of law, conceive of the ideal and the real as mutually regulating.

Hace menos de veinticinco años, el debate sobre la crisis del Estado de Derecho era inimaginable en la Unión Europea. Era plenamente compartido que la Unión solo admitía a Estados democráticos, respetuosos de los derechos humanos y defensores de las ideas de libertad. Tambien se daba por hecho que los candidatos, una vez ya dentro de la organización, solo podían perfeccionar y mejorar su respeto de los principios en los que se basa el Estado de Derecho como son el de legalidad, la separación de poderes, la rendición de cuentas, la independencia judicial y la libertad de prensa, entre otros. Sin embargo, las tendencias de los últimos años demuestran que se puede desandar el camino andado. En este sentido, en algunos Estados Miembros se detectan ataques esporádicos pero muy preocupantes a los valores en los que la Unión se basa, incluido el Estado de Derecho, mientras que en otros la deriva ya es directamente hacia una autocracia. Por ello, casi una veintena de investigadores europeos se han unido para presentar su diagnóstico y su pronóstico sobre esta enfermedad que padece la Unión en forma de crisis del Estado de Derecho, especialmente tras la COVID-19.

This open access book looks into the evolution and current state of the rule of law in the European Union (EU). The thirtieth anniversary of the fall of the Berlin Wall is chosen as a natural moment of stocktaking; assessing the progress made since the beginning of the democratic reforms in Central and Eastern Europe (CEE), but also critically analysing recent tendencies of rule of law backsliding and open revolt against liberal-democratic values in individual EU Member States. The volume is partly retrospective in that it reflects on the challenges of the post-communist transition and the process of Eastward Enlargement of the Union. Yet it is also prospective, in so far as it reviews the variety of novel mechanisms for strengthening rule of law enforcement in the EU and gauges their potential for bringing sustainable, positive change in this regard. All chapters are written by experienced scholars and practitioners in the field of EU law and policy. Seit einigen Jahren ist der Rechtsstaat in mehreren Mitgliedstaaten der EU unter Druck. Trotz unterschiedlicher Bemuhungen konnte diese Krise noch nicht gelost werden. Malte Symann analysiert die Moglichkeit, wie uber einen neuen finanziellen Sanktionsmechanismus die Rechtsstaatlichkeit in den Mitgliedstaaten besser geschutzt werden kann. Ohne derzeit politisch nicht erreichbare Anderungen der Europaischen Vertrage ist dies nur auf der Basis des europaischen Haushaltsrechts moglich. Durch einen solchen Sanktionsmechanismus wurden vornehmlich die finanziellen Interessen der EU geschutzt, mittelbar kann er aber auch allgemein zur Starkung rechtsstaatlicher Grundsatze in allen Mitgliedstaaten beitragen. Der Autor untersucht die bereits bestehenden Sanktionsmechanismen sowie weitere grundlegende Fragestellungen im Spannungsverhaltnis der EU zu ihren Mitgliedstaaten.

This book takes a wide-ranging approach to tackle the complex question of the current state of constitutional democracy in the EU. It brings together a broad set of academics and practitioners with legal and political perspectives to focus on both topical and perennial issues concerning constitutional democracy (including safeguarding the rule of law and respect for fundamental rights) in theory and practice, primarily at EU level but also with due regard to national and global developments. This is a book about the internal dimension of the rule of law in the European Union (EU). The EU is a community based on law which adheres to and promotes a set of common values between the Member States. The preservation of these values (such as legality, legal certainty, prohibition of arbitrariness, respect for fundamental rights) is pivotal to the success of European integration and the well-being of the individuals within it. Yet, the EU rule of law suffers from an imposter syndrome and has been the subject of criticism: ie that it is only part of the EU agenda in order to legitimise sweeping new powers and policies, and that it plays little or no role in promoting a culture of compliance for either deviant EU Institutions or for Member States. This book will examine whether the EU rule of law deserves those criticisms. It will offer an analytical guide to the EU rule of law by conceptualising it and locating it within the sources of EU law. It will then ask whether the EU is based on the rule of law - a question which is answered in the affirmative, but one which has to be considered in the context of compliance and the overall effectiveness of the EU enforcement acquis. It is argued that while the EU means well in its aim to preserve unity in an increasingly diversified Europe, the extent to which it can pave the way to a better world (based on a transnational rule of law concept akin to good governance and improvement of citizens' lives) is dependent on the commitment of all European integration stakeholders to the EU project.

There is widespread agreement that democracy today faces unprecedented challenges. Populism has pushed governments in new and surprising constitutional directions. Analysing the constitutional system of illiberal democracies (from Venezuela to Poland) and illiberal phenomena in 'mature democracies' that are justified in the name of 'the will of the people', this book explains that this drift to mild despotism is not authoritarianism, but an abuse of constitutionalism. Illiberal governments claim that they are as democratic and constitutional as any other. They also claim that they are more popular and therefore more genuine because their rule is based on conservative, plebeian and 'patriotic' constitutional and rule of law values rather than the values liberals espouse. However, this book shows that these claims are deeply deceptive - an abuse of constitutionalism and the rule of law, not a different conception of these ideas.

This book challenges the idea that the Rule of Law is still a universal European value given its relatively rapid deterioration in Hungary and Poland, and the apparent inability of the European institutions to adequately address the illiberalization of these Member States. The book begins from the general presumption that the Rule of Law, since its emergence, has been a universal European value, a political ideal and legal conception. It also acknowledges that the EU has been struggling in the area of value enforcement, even if the necessary mechanisms are available and, given an innovative outlook and more political commitment, could be successfully used. The authors appreciate the different approaches toward the Rule of Law, both as a concept and as a measurable indicator, and while addressing the core question of the volume, widely rely on them. Ultimately, the book provides a snapshot of how the Rule of Law ideal has been dismantled and offers a theory of the Rule of Law in illiberal constitutionalism. Tribalization is a global megatrend in today's world. The election of Donald Trump, the Brexit vote, populist movements like Catalan separatism - together with democratic backsliding in Central and Eastern Europe - are all examples of tribalization. Fuelled by anti-globalism and identity politics, tribalization is drawing up the drawbridge to the world. It is putting cultural differences before dialogue, collaboration and universal liberal values. But tribalism is a dangerous road to go down. With it, argues Marlene Wind, we have put democracy itself in danger. Tribalism is not just about being pro-nation, anti-EU and anti-global. It is in many instances a bigger and more fundamental movement that casts aside the liberal democratic principles we once held in common. At a time when former defenders of liberal values are increasingly silent or have even joined the growing chorus of tribalists, this book is a wakeup call. Do EU institutions have an influence on the implementation of the rule of law in potential candidate countries and, if so, of what kind? During the compliance monitoring process related to the effective rule of law and democracy the EU Commission tests and criticizes the effectiveness of the judiciary and strengthens the rule of law in preparation for accession. In the Western Balkans this was a process fraught with difficulties. Despite the fact that academic scholarship and democratic politics agree on rule of law as a legitimizing principle for the exercise of state authority, there is no uniform European standard for institution-building or monitoring activities by the EU in this area. With focus on the reform of the judiciary in five case study countries of Bosnia and Herzegovina, Kosovo, Macedonia, Montenegro, and Serbia, this empirical research investigates the EU's transformative power with regard to the effectiveness of rule of law and judicial sector reform in its infancy. It analyses the depth and limitations of EU rule of law promotion in the Western Balkans and presents policy recommendations intended to address the shortcomings in judiciary reform. This book aims to fill the gap in the existing academic scholarship of EU politics, law and Western Balkans literature.
