À l'occasion du vingtième anniversaire de la loi Perben II et du cinquième anniversaire de la LPJ portant respectivement création des JIRS et de la JUNALCO, l'ouvrage Droit et pratique de la lutte contre la criminalité organisée rassemble les praticiens et théoriciens spécialistes de la lutte contre la criminalité organisée en France et à l'étranger telle qu'elle se présente aujourd'hui et pour les années à venir. S'adressant à tous les professionnels du droit (magistrats, avocats, enquêteurs, fonctionnaires de greffe, universitaires), désireux de disposer d'un panorama complet sur « l'état de l'art » en matière de lutte contre la criminalité organisée, cet ouvrage rassemble les données criminologiques, économiques, textuelles, jurisprudentielles et institutionnelles de fond et de procédure, les plus à jour en la matière. Le Fonds monétaire international évalue le volume annuel des opérations de blanchiment dans le monde à 2 à 5% du PIB mondial en moyenne. Le trafic de drogue produit chaque année environ 400 milliards de dollars de profit par la vente au détail, soit près du double du revenu de l'industrie pharmaceutique mondiale, sans parler de la fraude douanière et des autres activités criminelles telles que la corruption, le délit d'écocide, le vol à grande échelle, le trafic d'êtres humains, le trafic d'organes, etc. Malgré des statistiques qui donnent la nausée, les Etats manquent de combativité face à cette peste qu'est la criminalité organisée, qui contamine tous les secteurs de notre société et réinvestit tous ces milliards dans l'économie licite. Fort de son expérience et de ses connaissances, Michel Glaise refuse la résilience et dénonce une situation qui menace nos démocraties. This Volume collects the proceedings of the first year of activities of the Jean Monnet EU-GLOBACT Course Transnational Crime and EU Law: Towards Global Action against Cross-border Threats to common security, rule of law and human rights co-financed by the European Commission (2023-2026), on the EU’s emerging global policy in the fight against transnational crime. The Course is designed to prepare graduates for their future professional lives and to provide specialised training for legal and political operators. This Book and the Project it represents aim to promote joint research and facilitate the exchange of ideas to identify solutions and examples of best practices in the fight against transnational crime that could be replicated by all States, both European and non-European, and to contribute to the development of legislation and policies in line with the values and principles of the EU. This is accomplished through teaching, research, and dissemination initiatives within the framework of the International & European Criminal Law Observatory (IECLO), based at the Department of Legal Sciences, University of Salerno, and by inviting leading experts (Italian and foreign) to participate in the course as lecturers and speakers. As part of the Project, these experts have collated their activities into written contributions published in this Book.

O crime organizado e económico-financeira transnacional, beneficiando da globalização, ameaça o Estado de Direito e a paz, constituindo um poder paralelo que condiciona e intimida os poderes legítimos dos Estados e Organizações Internacionais. As associações criminosas, na sua vertente mais violenta dedicam-se a crimes como os tráficos de pessoas e de órgãos, de estupefacientes e de armas, e na sua expressão económico-financeira, associada ao crime de colarinho branco, atuam no âmbito da corrupção, do branqueamento u do tráfico de influências. O seu combate exige dos Estados uma forte cooperação internacional já contemplada em Tratados, e outros Normativos Internacionais elaborados no âmbito da ONU, do Conselho da Europa, da OCDE e da União Europeia. Portugal dotou as autoridades de medida especiais de prevenção, investigação e repressão das associações criminosas, como a cedência do sigilo bancário e fiscal, a realização de ações encobertas, meios excecionais de recolha de prova e a perda alargada de bens e instrumentos. Na medida em que o crime organizado continua a prosperar e a ameaçar a soberania estatal, defendemos que, mais do que ampliar a legislação internacional nacional, deve urgentemente ser promovida uma real aplicação dos textos já existentes, através de efetiva dotação de meios.

La criminalità organizzata segue dappresso le evoluzioni che avvengono a livello sociale, economico e tecnologico e la Comunità internazionale ha varato negli anni una serie di iniziative come la Dichiarazione di Napoli del 1994 e la Convenzione di Palermo del 2000 per arginare i fenomeni delittuosi che si avvalgono sempre più di ramificazioni extra territoriali. Nell’ordinamento interno la tipizzazione del reato transnazionale ha suscitato da sempre numerose problematiche tanto in dottrina quanto in giurisprudenza. Le difficoltà maggiori si sono riscontrate nell’individua- re una esaustiva ontologia dell’istituto e nella presente opera vengono dettate delle precise indicazioni in ordine ad un nuovo inquadramento della fattispecie quale ulteriore nuova forma di manifestazione del reato. Ampio spazio è stato riservato ai profili di Diritto comparato per analizzare le diversità degli ordinamenti penali della Germania, della Francia e del Regno Unito. Vengono altresì analizzate le mutate interessenze del crimine organizzato che si muove avvalendosi di mezzi tecnologici mai adoperati in passato ove l’I.A. è un fenomeno che non deve essere tra- scurato.

For several decades, banks and other financial service providers have been required to monitor the activities of their customers in order to detect and prevent crime. This ‘delegated law enforcement’ has yielded some success, but its practical limits have become glaringly apparent, as the private sector is struggling to effectively perform this task. There is, therefore, growing international consensus that closer public–private cooperation is needed. This will require government authorities to share relevant information with the private sector on a regular basis, to facilitate the detection of criminal abuse of financial services. However, such cooperation raises profound fundamental rights concerns, because it can put the separation between the public and private spheres—a central paradigm of the rule of law—into question. A pioneering work in a subject that remains largely unaddressed by law and academic debate, the present study brings together the findings of an EU-funded project that developed recommendations for a legal framework for public–private information sharing to prevent, detect and investigate financial crime. To this end, the book explores the foundations of public–private cooperation against financial crime by adopting a pan-European and interdisciplinary approach. It brings together a comparative analysis of public–private cooperation in criminal procedure law and anti-money laundering law in France, Germany, Italy and Spain; an analysis of the practical design and law of innovative information-sharing mechanisms in the Netherlands and the United Kingdom; an in-depth study of the relevant EU data protection framework; an inquiry into the impact of automated methods of data processing on the applicable legal requirements; an analysis of financial information sharing between the EU and the USA; and a socio-legal study of the practical challenges encountered in public–private cooperation. These various findings are brought together to explain how legislators, competent authorities and the private sector can strengthen public–private cooperation to advance the fight against financial crime and ensure respect for fundamental rights. The recommendations are especially relevant in light of the EU’s recently adopted Framework on Anti-Money Laundering and Countering the Financing of Terrorism, which introduces ‘partnerships for information sharing’ as a new key tool for initiatives addressing financial crime and, in doing so, encourages the participation of competent authorities in such partnerships.
