This book provides for a comprehensive overview of the various areas of European labour law: fundamental rights, free movement of workers and posting, equal treatment, a-typical forms of employment, collective bargaining and collective agreements, restructuring of enterprises and health and safety.

The innovation economy is the driver for the development of the Fourth Industrial Revolution and consequently, there is a growing focus on innovation in general and technological innovation in particular. In this context, there is much to suggest that it is the triple impact of artificial intelligence, big data and 5G- and 6G networks that will go beyond the limits of existing competence. This book is about the new competence that is emerging in the wake of artificial intelligence and intelligent robots. It explains how these two technologies are completely fundamental to what is known as the Fourth Industrial Revolution. The author argues that artificial intelligence will promote automation, which will reduce wages rather than increase unemployment statistics. The book posits that when the utility value of technology and the rate of dissemination of technology is high, people who have the necessary competence will both future-proof their jobs in the labour market and also be among the highest-paid workers in the new economy that is emerging from the innovation economy. Further, by making education more compatible with new technology will enable graduates to access more secure and better paid jobs, and all behavioural fields related to new technology will flourish because they can be used in many contexts to steer people's behaviour in certain directions through the integration of big data and artificial intelligence. The book employs the following scholarly methods: conceptual generalization, scenario-based thinking and historical economic methodology, thus it will be of particular benefit to academic scholars, researchers and graduate students who are concerned with the impact of the fourth industrial revolution on the labour market.

European employment law is becoming increasingly important. Its impact upon domestic law of the Member States in fields such as fixed-term employment contracts, collective redundancies or industrial action, is growing. This volume therefore covers the complete scope of European employment law: its foundations in EU primary law and its various sources in EU secondary legislation, as well as the growing body of case law of the European Court of Justice.The book begins by providing an overview of the relevant fundamental rights, fundamental freedoms and competences of the European Union in the field of employment law. A systematic presentation of the conflict of law rules in European Employment Law then follows: the Rome I and Rome II-Regulations, the Posting of Workers Directive and the Brussels Regulation on the recognition and enforcement of judgements. Subsequently, the author focuses on individual labour law which, at the EU level, is principally composed of rules on non-discrimination, the protection of safety and health and working time; rules on atypical forms of employment (part-time, fixed-term and temporary agency work) and special groups of employees (mothers, parents, young people); as well as legislation concerning employment protection in situations of collective redundancy, business transfer and insolvency. This is followed by a discussion of collective labour law issues. Particular attention is given to the European Works Council and the rules on employee involvement in the European Company, the European Cooperative Society, and the European Private Company, and to employment law rules contained in the Directive on cross-border mergers.

This book examines the role of law in regulating and influencing the lived experiences of posted workers in Europe. The 'posting' of workers is an unusual type of labour mobility, where workers are hired out to provide a specific service in another country. Although it involves a specialised area of law, it is one that serves as a magnifying glass for the long-standing tension between the economic and social dimensions of law's regulatory role. As an atypical form of labour migration, posting also touches upon broader themes concerning the role and purpose of labour law in a changing world of work. Taking up these themes through interviews with posted workers, lawyers and employers, the book adopts a sociolegal approach to consider how the law shapes the precarious lived experiences of posted workers in Europe. Giving voice to those with first-hand experience, the book goes on to propose solutions that might address the precarity of posted work. This book will be of interest to scholars, researchers and practitioners working in the areas of labour law, sociolegal studies, EU law, and migration.

The relationship between technology and the world of work is not a new nor an easy one. From the Aristotelian concept of Τέχνη (tèchne) intended as an inherent dimension of any human productive activity, to the XIX century Luddites, and the current debates on the “de-humanizing” effect of artificial intelligence, it is widely acknowledged that technology and society - and therefore law - are constantly and mutually interacting. Labour law, in particular, stands as an ideal standpoint to observe the legal system’s responses to the digital revolution, insofar as the major concerns for a socially unrestrained use of technology regard precisely the impact of new technologies in the workplace. These and other issues have been originally discussed by the Authors of this book on the occasion of a co-teaching course on New Technology and Labour Law they gave at the Luiss ‘Guido Carli’ University in Rome, at the conclusion of which it came quite “natural” to transform such a didactic cooperative effort into a collective volume. We are confident that this text, born for students, will also be useful for advanced study and research in this crucial area of our contemporary societies.

Das Arbeitsrecht ist eine Materie, die stets im Fluss ist. Das gilt fur das Individualarbeitsrecht, das die Rechtsbeziehungen zwischen den Arbeitsvertragsparteien regelt, ebenso wie fur das kollektive Arbeitsrecht, das das Recht der Arbeitnehmer- und Arbeitgebervertretungen betrifft. Die Neuauflage berucksichtigt die gesetzlichen Neuregelungen der letzten Jahre, wie z. B. die Regelung des Arbeitsvertrags in 611a BGB, Anderungen des AUG, des MuschG und des Datenschutzrechts. Neben arbeitsrechtlicher Gesetzgebung pragt vor allem die Rechtsprechung die Rahmenbedingungen der abhangigen Arbeit. Die jungere Rechtsprechung des EuGH im Diskriminierungs- und Urlaubsrecht wurde ebenso eingearbeitet wie die Entscheidungen des BVerfG zum Vorbeschaftigungsverbot und zum Tarifeinheitsgesetz. Il manuale Diritto del lavoro dell’Unione Europea, giunto ormai alla nona edizione, si presenta ampiamente rivisto nelle varie parti e dà conto delle diverse novità, normative e giurisprudenziali, intervenute in un periodo profondamente segnato dalla crisi pandemica, che ha sfidato con forza le istituzioni dell’Unione, spingendole a un netto mutamento di rotta sul piano economico-finanziario e alla previsione di inedite forme di solidarietà. Nel triennio trascorso dal precedente aggiornamento un ruolo decisivo sul piano normativo ha occupato la direttiva sui salari minimi adeguati, a cui è dedicato un nuovo capitolo che arricchisce la parte terza del Manuale. Dessa förändringar och deras betydelse för svenskt vidkommande redovisas och diskuteras. I boken görs en grundlig genomgång av EU-arbetsrätten i förhållande till den svenska arbetsrätten. During the first two decades of the twenty-first century, the United States and much of the developed world were rocked by three successive economic shocks, each one more severe than the one before. Real relief from these economic shocks, of course, can only come from a restored economy--with balanced strength across many sectors and regions. Safety-net programs can also help alleviate this suffering. They provide urgent financial help and, when properly designed, can assist, motivate, or nudge recipients to seek and accept new employment. When necessary, they can help recipients to learn new skills and engage in other socially preferred behaviors. That is, they can "activate" the unemployed and underemployed.Work and the Social Safety Net: Labor Activation in Europe and the United States describes how in the 1990s and early 2000s many European countries adopted policy reforms aimed at activating those recipients apparently able to work. These policy reforms were put to the test during the Great Recession and its aftermath. This volume reviews the experiences from both Europe and the United States during this period, and includes two chapters apiece on unemployment insurance, social assistance, disability, public employment services, and political economy. Work and the Social Safety Net identifies policies for activating recipients of safety-net programs while still preserving a strong social safety net--as a guide during the economic recovery from the COVID-19 pandemic and future downturns.

Le droit du travail connaît, depuis le début du XXIe siècle, une mutation profonde qui autorise à parler de nouveau droit du travail ou de refondation du droit du travail. La révolution numérique, avec désormais les défis de l'intelligence artificielle, modifie avec une intensité et une célérité étonnantes les métiers, les compétences, les organisations du travail. Certes, toutes les activités ne subissent pas de la même manière cette révolution. Mais l'organisation traditionnelle du travail marquée par une unité de temps, de lieu et d'action, avec un rapport hiérarchique bien affirmé, cède, de jour en jour, du terrain. Dans cette économie de la connaissance qui connaît un développement exponentiel, le télétravail régulier progresse, de nouvelles organisations apparaissent (co-working, travail en réseau...), l'autonomie s'accroît, les transitions professionnelles se généralisent, la quête d'une qualité de vie au travail dans le cadre d'une conciliation différente de la vie professionnelle et de la vie personnelle s'intensifie et les attentes des jeunes travailleurs évoluent. Pour répondre à ces nouveaux défis, le législateur a offert une place importante à l'accord collectif de travail qui est ainsi devenu le centre de gravité de la production de la règle avec une primauté de principe de l'accord d'entreprise. Cette évolution n'altère en rien la diversité des fonctions du droit du travail. Le droit du travail protège le salarié, organise la collectivité de travail, réglemente le marché du travail, favorise l'emploi, met en place des dispositions d'organisation du travail dans l'entreprise, s'attache à concilier performance économique et progrès social dans le sillage de la flexisécurité prônée par l'Union européenne, sans oublier les préoccupations environnementales.
C'est dans ce contexte que s'inscrit le présent ouvrage dont l'objectif est de permettre aux étudiants (licence et master) d'acquérir les fondamentaux du droit du travail et d'accompagner aussi ceux qui le pratiquent au quotidien. La première partie est consacrée à la relation de travail (contrats de travail, rémunération du travail, conditions de travail). La seconde partie met en lumière la collectivité de travail (représentation collective, négociation collective, conflit collectif).
