Abstract by the author: The European Union (EU) has thus far developed a standard approach towards the negotiation processes and the content of readmission agreements with third countries. This approach encompasses offering a visa facilitation agreement and visa liberalization to third countries as an incentive for the conclusion of a readmission agreement. The approach has, however, changed in the case of the EU-Turkey Readmission Agreement. This Agreement was signed simultaneously with the initiation of a Visa Liberalization Dialogue, by-passing the conclusion of a visa facilitation agreement. The content of the Agreement has also distinguishing features compared to EU readmission agreements. This article seeks to explain why the EU has changed its standard approach in the case of Turkey through analysing both the negotiation process and the content of the EU-Turkey Readmission Agreement. In this way, this article strives to demonstrate that this shift is mainly due to EU’s concerns about effective return of irregular migrants who have been ordered to leave the EU, as well as the unique characteristics of the multidimensional relationship between the EU and Turkey.

Abstract by the author: In November 2014, Frontex started its Southern Mediterranean border monitoring operation Triton, followed in June 2015 by the Common Security and Defence Policy anti-smuggling mission EU Naval Force Mediterranean (EUNAVFOR Med) ‘Sophia’. Both operations’ outward communication has placed considerable emphasis on the conduct of maritime search and rescue. Still, this commitment was not matched by consistent action. Triton and EUNAVFOR Med have conducted a relatively limited number of search and rescue operations, prioritizing border control and anti-smuggling tasks. This article explains the gap between the European Union missions’ humanitarian rhetoric and an operational conduct primarily focusing on curbing irregular migration as a form of organized hypocrisy. Decoupling talk and action allowed Triton and EUNAVFOR Med to reconcile the conflicting expectations arising from European governments’ willingness to reduce migrant arrivals and the normative imperative to act against the loss of life at sea. However, the European Union missions’ organized hypocrisy had several negative externalities, hindering effective management of the humanitarian crisis offshore Libya.

Abstract by the authors: Austria and Italy have recently proposed that processing the protection claims of asylum seekers attempting to cross the Mediterranean should take place aboard government vessels at sea. Shipboard processing of asylum claims is not a novel idea. The policy has been used for many years by the governments of the United States and Australia. This article examines the relevant international law, as well as State practice and domestic jurisprudence in the United States and Australia, to explore whether shipboard processing complies with international refugee and human rights law. It concludes that, while it may be theoretically possible for shipboard processing to comply with international law, there are significant practical impediments to carrying out shipboard processing in a manner that is compliant with the international obligations of States. Current practices in the United States and Australia fall short of what is required. Nor is there any indication that the Austrian/Italian proposal would contain the required safeguards. It is argued that this is by design. The appeal of shipboard processing for governments is that it allows them to dispense with the safeguards that asylum seekers would be entitled to if processed on land. Best practice is for all persons interdicted or rescued at sea to be transferred to a location on land where they have access to effective status determination procedures and are protected from refoulement and unlawful detention

Abstract by the author: This paper measures the links between aid from 14 rich to 113 developing economies and bilateral asylum applications during the years 1993 to 2013. Dynamic panel models and Sys-Generalized Method of Moments are used. The results show that asylum applications are related to aid nonlinearly in a U-shaped fashion with respect to the level of development of origin countries, although only the downward segment proves to be robust to all specifications. Asylum inflows from poor countries are significantly and negatively associated with aid in the short run, with mixed evidence of more lasting effects, while inflows from less poor economies show a positive but non-robust relationship to aid. Moreover, aid leads to negative cross-donor spillovers. Applications linearly decrease with humanitarian aid. Voluntary immigration is not related to aid. Overall, the reduction in asylum inflows is stronger when aid disbursements are conditional on economic, institutional and political improvements in the recipient economy.

 

Abstract by the author: The European migration crisis of 2015-2016 and the migrants from Central America gathering on the US border since 2017 have created headlines and presented challenges for Western governments. In this paper, I examine the trends in, and determinants of, the number of asylum seekers applying for refugee status in the developed world. This must be understood against the background of an international policy regime that evolved in response to refugee crises and geo-political imperatives. While policy has drawn a sharp distinction between refugees and other immigrants, that difference has become increasingly blurred among asylum migrants. In this light, I examine the interplay between migration pressures, public opinion, and asylum policies in recent decades.

 

Abstract by the author: The changes in the 21st century have brought new threats and problems for the international community. The European Union, as one of the most important actors in the world, was forced to change its approach to a new situation, which is characterized by the presence of threats such as illegal migration, huge refugee influx and the existence of fragile states in its neighborhood. The main objective of this paper is to present the EU's engagement in stabilization of fragile states through civilian and military missions and operations to hold illegal migration. It answers the question whether the actions undertaken by the EU are powerful. The analysis of the operations and missions in chosen states (Somalia, Libya) shown that although the influx of migrants and refugees is lower, the changes and the influence of actions helping them to become stronger and more secure states are rather minor The conclusions comprise several thoughts which should be taken under consideration by the EU in the future in order to support European security and wealth.

 

Abstract by the authors:  Recent migration ‘crises’ raise important geopolitical questions. Who is ‘the migrant’ that contemporary politics are fixated on? How are answers to ‘who counts as a migrant’ changing? Who gets to do that counting, and under what circumstances? This forum responds to, as well as questions, the current saliency of migration by examining how categories of migration hold geopolitical significance—not only in how they are constructed and by whom, but also in how they are challenged and subverted. Furthermore, by examining how the very concepts of ‘migrant’ and ‘refugee’ are used in different contexts, and for a variety of purposes, it opens up critical questions about mobility, citizenship and the nation state. Collectively, these contributions aim to demonstrate how problematising migration and its categorisation can be a tool of enquiry into other phenomena and processes.

 

Abstract by the authors: For decades, countries aspiring to join the European Union (EU) have been linked to it through migration. Yet little is known about how migration affects individual support for joining the EU in prospective member states. We explore the relationship between migration and support for EU accession in the Western Balkans. Using data from the Gallup Balkan Monitor survey, we find that prospective and return migrants, as well as people with relatives abroad, are more likely to vote favorably in a hypothetical EU referendum. At the same time, only people with relatives abroad are more likely to consider EU membership a good thing. Our results suggest that migration affects attitudes toward joining the EU principally through instrumental/utilitarian motives, with channels related to information and cosmopolitanism playing only a minor role. Overall, we show that migration fosters support for joining the EU in migrants’ origin countries and that joining such a supranational institution is likely to foster political and institutional development of migrants’ origin countries.

 

Abstract by the author: While images of boats in distress, overflowing with migrants in the Central Mediterranean, flash on television screens and front pages of Italian and European newspapers, search and rescue (SAR) missions continue to draw attention. This article takes a look at migratory flows across the Central Mediterranean from 2012 to 2018 and focuses on the response of governmental, inter-governmental, and non-governmental actors rescuing lives at sea. Using aggregate data on migrants’ sea arrivals and deaths as well as official documents from the UNHRC, the European Union, Italy’s Ministry of Interior, and NGOs, this study investigates 1) how different actors have responded to migratory flows across the Central Mediterranean, and 2) how actors’ narratives and response have impacted the situation at sea. The study finds that, although all three actors act on the humanitarian principle ‘to save lives,’ their narratives and response diverge as the intensity of sea arrivals persists.
